Urgent -- Job title change before I140

My company applied for labor in Jan 2005, EB3 category. At the time of this application, my job title was Programmer.

I got promoted six months back and my job title changed to Senior Programmer Analyst. My duties and responsibilities have not changed a lot though.

I got my labor approval recently.

Somebody told me that get promoted and changing the job title will affect I140 filing. Is there any way I can file for I140. What would be the best course of action.

Please reply. I am in kind of bind, have to decide the course of action by tomorrow. Appreciate all your help.

Thanks.

Pl reply

All, Pl reply. I am stuck and have to make a decision soon. My company's HR dept has asked me to forget old approved labor and file for a new one.

As long your job responsibility is similar you are in the same job classification, job title is not an issue.

No I140 donut for me!!

The discussion amongst my employer and *his* lawyer has come to a full circle. They have decided that I cannot apply for I140 under old approved labor, since my current title does not match with that of one on the approved I140. They say that I have to file for new labor under perm, the filing of which looks like atleast 3-4 months away.

Would there be any way, any legal documentation, comments, guidance which can state that I can apply for I140 under old labor appln, even if my job title has changed; my basic job responsibilities remain the same.

Eagerly awaiting for your response. Pl reply.

Thanks.
