Urgent Issue: I-485 Rfe Response

Hi All,

May 16th, I got a RFE on my I-485 from NSC. USCIS sent this request directly to my lawyer. I called my lawyer couple of times and left a voice message and they did not respond due to filing new applications.

I called USCIS yesterday to send that RFE to my home address so that I know what is that for. USCIS officer told me that he can fax a copy of that RFE to me but he cannot send another copy to my adddress but he said that he can send another copy of the same to my lawyer once again.

I received the fax and the RFE is for submitting my latest EAD approval and my latest I-94 copies. I really wonder why USCIS is asking this since they have records to verify the same. This RFE is signed by one of USCIS Directors.

My question is: CAN I SEND THE RFE RESPONSE DIRECTLY TO THE USCIS? WILL THEY ACCEPT THAT?

SINCE MY LAWER IS BUSY IN OTHER ACTIVITIES I DON'T WANT TO WAIT FOR HIM TO ANSWER AND IT MIGHT DELAY MY ADJUDICATION.

Please share your experience and knowledge about handling this.

PD: Oct 2001 (EB3 - INDIA)
I-485 Filed - Dec 2003.
Case transferred from CSC to NSC on Feb'07.
Name check cleared on March 2007. (FBI took 3 years 3 months to clear)
Did the latest finger print on April 2007.
Got RFE on May 16th.

Typically RFEs come with a specially bar-coded reply envelope -- this would ensure that your reply gets attached to your case correctly.

You can send it on your own -- but it is best if you can somehow use the original envelope -- if the attorney is busy (which is BS considering you are a CLIENT !!), ask them to send you the RFE papers so that you can answer it yourself.

Just send the response yourself in the meanwhile -- I don't see any harm with it.
 
Better wait for it

It is clearly written on RFE that you need to send the RFE letter along with your response.


Or try calling Service center once again and ask for a copy. You are allowed to send the response along with a copy.

My experience

The same thing happened to me.
I got RFE email on 4/11/2007. My lawyer office moved and the letter got returned. Besides, the lasyer already collected all fee and not very interested to help.
I called USCIS and a very nice lady sent a copy to my home. And I replied with the RFE letter and the doc they requested by myself on 05/18/2007.

This morning I got email my GC is ordered. I am very happy.

Congrats for having 485 approval. Just do not understand how do they process.
I applied for my I-485 in September and have RD of 10/08/2006. I have also received RFE in March and I replied in April and after that no update. You replied in May and they approved u r case. I thought they go by FIFO for I-485.
 
I don't understand them either

The long journey took me 5+ year. From my experience, I would conclude that Lottery is more predictable than the speed of your GC application.

Please keep your finger crossed! There will be lignt at the other end of the tunnel!

Finally my lawyer responded my RFE on 12th. I got CRIS automated message on 13th that they received my RFE response and the case staus resumed. It also mention that we will get a written letter of their decision within the next 60 days in case if they don't want any more finger print or interview... BTW. I did my last finger print in the first week of March 07.

Is this the I-485 RFE response message common?

Hope my case is approved within the next 60 days from today.

Good that your attorney replied and USCIS received the RFE reply.
But The "60days blah,blah,blah" is a common message online to tell us that RFE reply was received and case status resumes.
I'm seeing that message on my case status for last 9 months.

Hope this helps you not to trust these USCIS messages...it means nothing!!!!
