urgent inputs needed on switching jobs (AC21)..

Hi,
I'm due for a 2nd FP next week for my March 2002 RD case.
Currently I'm working for my original sponsor on H1B. I also have a valid EAD.
I've an excellent offer from another company but they need me urgently and they are willing to do only a temp to hire position due to their long HR process (its a typical big company). I could be contracting for a couple of months before I become full time. I'm willing to take a calculated risk as I'm not willing to let this offer go.
The questions to experts are :-

1) Can I work on a 1099 directly with them on my EAD ? I know technically I can but what do I show in the case if I get an employment RFE ? I've seen conflicting opinion but the nays have not been able to support their opinion by citing any INS decision or document. In fact the RFE often asks for "W2/1099" . What are the members opinion or can anybody point me to successful or denied cases based on this ?

2) If the above is not an option I can always involve a consulting company and get regular paystubs/W2 by giving them a cut. Will this be a more acceptable position to INS for paystubs and company letter etc ?

Any inputs will be welcome.
Thanks in advance.

Go with 1099 if you like it more

Go with 1099 if you like it more becasue in case of RFE you still have 2 months to reply, so you will have time to become FTE or find a consulting company

I have similar situation. I was thinking about doing it corp to corp
not 10-99 but it's almost the same. Problem is with RFE and pay stubs...But I was thinking that I can always go for 2 months vacation can't I? So I woudln't have pay stubs anyway.
