I'm from India and I came to this country 3 years back on H-4 visa. In 2004 October, I got my H-1 and I started working from early 2005.
Recently, I lost my H-1 approval form. Also, my H-4 visa expired last year. I applied for duplicate H1 copy (I 824). Currently, it is taking more than one year to get a duplicate H-1 approval form. My current H1 will expire on Apr 2007.
Meanwhile I may have to go to India for a brief visit. As mentioned above, since the visa(H-4) in my passport has expired, I need to get my H-1 visa stamping.
The alternative I have in front of me is to apply for a new H-1 under premium processing. I have a question, if I apply for a new H-1, what would be the expiry date of my new H-1?
Will I get upto Apr 2007(since my current H-1 expires in April 2007) Or will I get 3 more years extension from now? If I get my H-1, I'm planning to go to Canada for my H-1 stamping. Also, I have another question. I was told that all fresh H-1 candidates need to get stamped in their home country. Is that true or can I get stamping in Canada/Mexico?
Please answer these 2 questions ( A: Expiry Period of my new H-1; B: Getting stamped in Canada/Mexico instead of home country). I appreciate your response and your answers will be a great help to me.
