Urgent Info required on H1B re-stamping.

Hi,

I am currently working in US from Nov 2004, I have a valid visa till 2007. This is with my previous employer. I happen to change my employer recently 2 months back.

Is it advisable for me to go for re-stamping with the current employer's Petition paper ? As my H1B transfer has been approved. Or can I re-enter into US again after visiting India with the same visa of my previous employer ?

In addition I also have a problem with my passport, the first name and last name have been interchanged, I would like to know does this create a problem while I am re-entering into US again, I have already entered US twice before with the same passport.

I am not sure how the name is spelled in Petition, whether it is Firstname, Lastname or viceversa. if it is the first option as First Name, Last name then my name matches with the passport and visa stamping or else I will need to know how do we work around in this scenario.

Any advise in above situation in welcome, Also please let me know if I need to get re-stamped, Can I get it done in Cannada without any problems.

I appreciate your help and time on this matter since I am planning to visit India in coming month.

You can use the visa with your previous employer for traveling abroad and re-entry purposes, even though you don't work for that employer any longer.

You should have corrected your name in the passport. I cannot advise on how you can proceed to correct your name in the passport and also in the approved petition.

You should not have any problem re-entering U.S. based on what you mentioned.

Re-stamping your passport is not necessary as you can re-enter on the basis of visa stamp in your passport. However, if the visa with your former employer expires and you travel outside U.S., you must get the visa stamped on the basis of new approved petition, whether it be in India, or Canada, or Mexico.

Don't know (as you have problems with your name in the passport and/or petitions). You should start acting to correct your name in the passport and/or approved petition atleast now.

Corrections in the passport must be done at the place and by the agency that issued the passport. Start researching on how you can correct your name in the passport so that you can correct it when you visit India next time. Also, call USCIS (their toll free number is available on www.uscis.gov) to know whether you would face any problems at the time of re-entry in case you correct your name in the passport and what documents you need to produce at port of entry in such a situation for safe re-entering.

Even, if you don't want to correct your name in the passpost in your next visit, you should be able to re-enter without any problems as before.

But, I urge that you start thinking about correcting your name in the passport in your next visit to India and do the necessary research to tackle the situation.
