same situation
Well guys, I have similar problem, but I try to do whatever necessary things. Call IRS 1800 number, they have electronic phone where you can just dial all the necessary things they said. When you finished, they will send you the copies by few days! Do it fast.
Second option, go to your local IRS office, ask for the copies, they will provide copies to you by few days by mail.
I submitted only W-2s for my AOS paper. But my interview will be very soon (November 19, 2003). Here where I start got panic....I am the 'alien'...I do all the paperworks, very nice, very complete, very professional. For few months, my husband keep telling me W2s is enough and its the same as tax return. Being naive and never know how US tax systems work, I believed him. But....when I read more and more about AOS interview in the forum in the internet, I saw so many ppl talking about 'return tax'...then I started to do my search about two weeks ago. Then....I asked my husband to go to IRS and asked for copies of the last 3 years and thought everything will be just okay.
Here come the problems...he only got his tax for year 2000. He is in the army. I start wondering why he only got for one year.
He called IRS then they told him, they received his filing (by E-File through their website for 2001 and 2002). But they stopped it coz' he keep changed the address for every year!!!! Of course coz' he is an army. But they said, when they see that, they will stopped and not proceed with it because they worried if its a fraud...oh well, at least I hope they will inform you. The officer said my husband need to refile with papers. Don't we thought internet suppose to make your life better?
Now....I am getting panic and frustrated with it coz' I have everything so neatly compiled, but because of tax return (the MOST IMPORTANT THING IN AOS)...my case may be delayed.
But I also not give up that easy...I tried my best by:-
1. Asking the IRS officer to write a letter explaining the situation why my husband's tax return cannot be produced and she AGREED to do that.
2. By filing his tax return with HR Block and he can get the confirmation of filing on the very same day. IRS said, they authorized HR Block.
3. Provides the most recent pay slips.
Besides being panicked, I also read in the AOS I-864 and my interview letter that:
"Provide the 3 years recent tax returns, if less, please explain".
So, I hope all my other alternatives to get the explanation will be enough for the interviewer.
I hope whoever has the same experience, and went to the interview, pls share your story.
Moral of the story: For US citizen or petitioner....check your tax returns to make sure its filed! And of course...NEVER GIVE UP! Do whatever you can.
