Urgent - Incorrect info on new EAD/old one expires in 2 weeks

Hi,
I had applied for a renewal for me and my wife's EAD card on July 28th 2004.

I got 2 receipt notices in the first week of August. Both were in my wife's name.

I called the USCIS and they took my information and sent it to Vermont several times. I wrote a couple of letters too asking them to correct the mistake. They said that it has been taken care of.

But when the card came, it had my photo and signature and wife's name and her details like her Alien number, her DOB, etc.

I called USCIS again and they advised me to send back the EAD card and a letter explaining the error. I did it on Oct 28th and they received it on Oct 30th.

When I received no response or letter back from Vermont, I went to the Hartford office to explain my case. The officer there took copies of my letters and talked to someone in Vermont. She said that the files had been moved to storage and she would call me when they are back from storage.

When she called me back she told me that since I had sent back the EAD with the incorrect information, she will take my new EAD application form and new photos but they cannot issue a interim EAD or process my application until their system shows that they have received the EAD that I returned back to them and that this process might take a while, nor will they issue a new card for my wife.

Our current EAD card expires on Dec 16th 2004, I don't know whether I will get the renewal by that time.

What options do I have ?

Can I still keep working after Dec 16th, because it is their fault ?

What does the law say ?

Thanks a lot for your help,

Pranav Trivedi.

When I got my first EAD (which should have a valid date from 1/5/04 - 1/5/05 it was given as 1/5/03 - 1/5/04) there was an error and my lawyer sent a letter to USCIS (TSC) but even before his letter reached them I got my new card. I don't know if it was because they realized the mistake or due to my call immediately when I got the card. It couldn't be my call as they did not ask my A# or anything that identifies my case.
