I140 AD 12/12/02
It's Bizarre! I called up TSC today and after trying for 50 times i got through. Then a lady picked up after 5 minutes of wait, and then she put me on hold for another 30 MINUTES! I gave her my receipt number and then she put me on hold for another 10 min. Then she said my I140 is pending (what the f**?)
I told her 'but, it was approved on Dec 12th'. Then she said, 'oh! yes! she approved it on Dec 12th. But I dont know why she has kept the file on her desk. She is in the middle of a special (!?) project and she wont be looking into these files until 21st of these month.' I dont know who that 'She' is? i presumed, that was an officer.
I was speechless. I asked her, if she can find out why that file is still sitting out there when it is supposed to go to NVC. She said that all she can do is to send an email to 'her' and wait for 'her' response. So, I told her i will call back in couple of days.
Guys, anybody had a similar experience like this? And, what is the best way to deal with this problem?
Thanks

Ask your lawyer to help!!
Mine is even worse than yours. I got approval on 8/15 and I check in the beginning of Oct and still no news. The lady said she would send the request to send out my approval to NVC and that's all she can do ( just like you ). And No News again!! I talked to my lawyer in the middle of Oct. and she said she would send an email to I-140 supervisor to describe my situation. Finally, NVC received my case on 11/1.

Hello,

I know it is very frustrating.... But this is their normal procedure. After the approval date we expect that the file now be sent to NVC asap. BUT BUT BUT.... It takes about a month to reach NVC. And then NVC will send you a letter saying that they received your 140 approval and please sign and return a letter confirming that you do not wish to go for Adjustment of Status and would like to continue with CP.... (The most unnecessary stuff.... When we have mentioned CP then we want CP... But thats their procedure). So now then you have to sign and send back the Letter and even if you dont send it then by default they proceed with CP after 30 days from the day they sent that Letter.....

All this procedure will take atleast 60 to 90 days.... So Be Patient.

And Pray that you get lucky on this.

Take Care,

Actually, if you look at other posts and cptracker, for most of the people, I140 reached NVC in less than 22 days. In fact, couple of users of this forum who had their I140 approved on Dec 11th and Dec 12th, had their visa fee bill sent already. But mine, though approved on Dec 12th, still sitting at TSC. I dont remember anybody getting a letter recently from NVC, asking if they really want to go for CP.
But I called up TSC again yesterday, and they told me that they will send a request to forward my I140 to NVC. I had also sent a fax just for the record. I will check with NVC again next week and see if i am lucky.
