Hi Gurus,

Both me and spouse got I485 RFE for medical for two absurb case due to a very bias/bad doctor:

a) my spouse case is completely ok, but the doctor did not sign the I-693, hence he's getting RFE to ask doctor to sign it.

b) I am also getting RFE for medical because that doctor said the TB skin shows positive. I remembered we had a conversation with the doctor (when he checked the skin "many" days later), that I had some itchy skin, so I scratched it. It was not even a slump! Worse - I am pregnant and prefer not to do X-ray; doctor said it is ok, don't worry. But, now I know from RFE that the form was saying I had > 5mm slump.

c) the old doctor's hand was shivering when was taking blood; dropped a pen and file twice etc. I really worried about his competency!

d) the doctor was charging 3-4 times higher than some other local doctors

My question:

1. Can I change a doctor and summit a brand new medical exam form when responding to the RFE?

The RFE was saying I have only a chance to provide all evidence, and if I choose to provide other kind of records, then I am suggesting them to make a decision (approve/deny) based on the evidence I provided.

PLS HELP! BAD BIAS DOCTOR AGAINST IMMIGRANTS....

There is no harm to change a doctor (USCIS approved).
Here I would like to mention one of my friend moved from CT to FL and resent all I-693 in response to the RFE both for himself and wife.Yes, they did send X-Rays too, just in case.

thanks assur for your reply. My worried is that in the RFE it says go to the same doctor. Do you know if your friend get another RFE after re-sending I-693 from a new doctor?

thanks a lot for this valuable information.

He got approval without further RFE.

get a copy of the files the doctor sealed

You can ask for a copy of what the doctor sealed. In this way, you can identify anything missing or incorrect and ask him to change it before the document sent to USCIS.
As least our doctor office gave us the copies with the sealed ones.

Good luck!

I had exactly the same skin test skin problem. When I got the RFE I already moved. My first thought was try to avoid taking medicine. So I went to talk to another USCIS physician locally but she insisted I should take treatment. In the end I started to take medicine (6 month treatment, instead of normal 9 months). I responded the RFE with the evidence that I was taking treatment. USCIS then did not say anything about it. My 485 was approved.

Need Clarification on this

Hi Guys,

I am new to this forum and would like to have an answer to these questions.

How would you define exceptional ability( Who is Not seeking National Interest Waiver) in the EB-2 category?

What majors are classified as Sciences?

Your help would be very much appreciated.

There is no Exceptional Ability category in the EB2 category......at least to my knowledge....There is only NIW...anyone? EA is EB1 catergory subsection.
