Hi All,
Here is my situation, I came in United states in 2002 on F-1, fell in love, got married last last year and I have filled for Adjust of Status I-485 earlier this year in Jan 2007. Same time I have also filled for EAD card, after waiting almost five months I have received a letter that my petition for I485 has been denied, because;
Initial evidence submitted with my application was not sufficient to establish eligibility for the benefit sought.
In February 2007 immigration has requested my attorney to submit a completed and signed form I864(Affidavit of support) and a copy of the my birth certificate, and they had given my attorney 87 days to submit the required documentation in support of my application.
Now my attorney is telling me that he had sent them the above required information on time, but the reason why my application was denied because in February 2007, in response to the services request for evidence submitted the form I864 however, my attorney failed to submit a copy of the my birth certificate.

So now my question is how to file a motion to reopen and moreover I only have 24 more days, Should I change attorney, if yes how to find good attorney who can handle my case at this situation.

Any help, advice, or suggestion would be appriciated........

I would really appreciate if you could help me out and advice me what to do next.

Best Regards.:(

Hey,
I am sorry about what you're going through, but your situation is quite easily rectifiable. I'd start with firing your incompetent attorney and hiring a reputed one...perhaps even the Law Offices of Mr. Khanna. Whomever you would hire would file a Motion to Reopen (MTR) and can work with you and USCIS to resolve this situation. Time is of the essence, so I'd suggest to get moving on this sooner rather than later.
