Hello,

I have a substitute labor of 2002. My lawyer filed I-140 and I have a receipt for the same but not an approval since it was filed on July 5th 2007.

I will be completing 6 years in august. My H1B visa expires on August 1st 2007. Now my question is whether my stay is legal without filing for H1B. Can H1B be filed on the basis of RECEIPT of I-140 or an I-140 approval is necessary?

Your help will be very appreciated. Thanks.

File for H1B 1 year Extension

Hi,
I think you have only option to file for 7th year extension. If you have approved 1-140 and it's been approved more than a year, you can get 3 year extension. At this stage you need an extension on H1b to maintain your non-immigrant status.

Thanks
Susi
