Ours is quite a complex case. My husband' completed his six year H1 term in April of 2003. But we were on EAD at that time.
In Feb 2004 we moved back to India and yesterday we got to know that our 485 has been approved.
If my husband has to come back on a new H1:
1. is he eligible to apply for one right away
2. does he have to wait till Feb 2005 to complete one year (of staying outside U.S.).
We are aware of the fact that a new H1B means that Green card approval is cancelled. But at this point this is the only option to get back in to the country since our Advanced Parole has also expired.
Please give me ur valuable suggestions.
