Hi gurus,
My 485 got denied last week. it took 2 week's for my
lattorney to in form me.The reason for deniel was my
140 got revoked by USCIS.
i swiched employer after my 140 approvel and passing
180 days of my 485.The sent me an Intend to revoke
3 month back for ability to pay on the apprved 140.
My attorney sent them an ac21 stating i changed employer.
But i believe the UCIS didnot accept it.They want an new
labor cert.After waiting 4 yrs since 2001.I lost all hope.
Is there any way to apeal this one.
My new employer is financialy strong.
please give me any sugestion.please help
 
Respond to that notice within 2 weeks with the proof of your current employment.
Make sure you send Current EVL, paytubs and new AC21 memo.
If available, send a copy of your company financial statement.
Ability to pay on the apprved 140 don't make sense if your pay meets LC figure.

I am sorry. But, i can't understand how they can reject as your looks valid AC21 case. Did your attorney responded with employment in same/similar area and same job title with new employment verification letter from new employer along with AC21?

Is your former employer revoked your 140? Can yo please give more information on your case?

I think you should send follow it up with your lawyer asap with MOTR.

I have seen couple of cases where USCIS revoked approved I140 though, Employer didn't revoke it.

Don't know what USCIS doing, this is total injustice to us. I understood from this how US Gov. is doing for hardworkers, skilled and talented people, if they gave GC, US economy will expand and grow more, there is big loss to US Gov. only due to all this bullshit, and on other hand still they are giving Lottery based GC's, refugees, illegal and much more.......

File and Appeal or Motion of Reopen

There are two ways of revoke negative decision from CIS. One is to appeal to a higher comission. Another is to open a Motion of reopen/reconsideration. Some application can only use the later one. You can provide more information to prove the negative decision is wrong / based on incomplete information / not following proper procedure, etc. You can check USCIS web site about more detail. Note that reopen and reconsideration has diffrences.

I fileed a Motion of reopen before for visitor visa extension of my parents in law. It was denied and I successfully revoke it by filing a Motion. So there is no hurt to try. At least you get some extra time and a second change to win.

Just you need to file appeal/Motion within certain (maybe 15) days. So, act quickly!!!
