My mother-in-law was issued a 10-year visitor visa in 2002. She came to the US on the visa and during her stay, also visited her other daughter living in Toronto. While going to Toronto, I made sure that she did not turn in her I-90 form at the airport. But while in Toronto, her daughter and family travelled on tourism to NewYork and back. During this process, they made the mistake of surrendering my MIL's I-90 at the Canadian border. She was issued a new I-90 on her return to the U.S. Unfortunately, her new I-90 had an expiry date that was almost a month earlier than her original I-90 form.
I was not informed about this by my MIL cause she does not speak English and did not understand what actually happened. On the day that she was leaving the U.S, I noticed the new I-90 form with the new date and realized that she was in the U.S. for almost 10 days after the expiry of her I-90 date. At that point, there was nothing much I could do about it. I know that because of this, her 10 year visitor visa is now not valid anymore.
Does she have to apply for a brand new visitor visa? If yes, what are her chances of obtaining a fresh visitor visa? Thanks for all your input.
