My husbands visa expires on sep 30 2008 and in july 08 , we have applied for (normal processing) extension, but as of now processing is being done for people who have applied in april so we may get our petition in october i think as per those calculations . so can
1) my husband can apply for premium processing while normal processing isgoing on.
2) can my husband stay in US after sep30 (any grace period) getting petiotion approved.


Help is highly appreciated.
 
Yes your husband can upgrade the H-1B application to premium processing (15 calendar days turn around time). What's his current status?
 
All right ... in the current scenario, your husband can work for the new employer as long as the new H-1B is pending even beyond September 30, 2008.

No need to go for premium processing.
