Hi
I'm currently on H1 VISA valid till March 2006. I'm getting the salary without break. I applied my GC through another company as a future employee. I got I-140 RFE. RFE was related to bank statements and tax returns of the company. My attorney also asked me to send Two years W-2 form and last four pay stubs. Future company labour certfication says my salary will be twice than current salary. Now my attorney asking the future employer to send the current pay stub. My I-140 ND is 02/05/2004 and My-485 ND 03/05/2004. Due to RFE I did not receive my EAD and AP.Anyone have faced similar problem?. How to go about it. Please advice me.

Hello thota,

BCIS would need tax returns of the company that sponsored your GC. I don't think they care how much you make right now on H1b. You should be fine, as long as you are being paid as per the LCA (H1B) by the current employer. What is important is that the company that sponsored your GC as future employee should submit the tax returns that are good enough to prove the financial ability.

You may read the recent memos on this subject.

Thanks,

what if u get salary hike while i-140 in progress

just got an I-140 rfe requesting
1. info confirming my training ,
2. letter from my company relating to my qualifying experience
3.company's ability to pay
4. info abt the person who held my job in the past and what they paid him and why he left. unclear what documents to show to prove that he left and what he got paid. the company thinks a letter from them will suffice

i am a physician in the second year of my 1st job.

what did u get rfe for and how did u successfully reply to it. can u e-mail me the sample letter u sent with your reply.
