Urgent Help Needed -adoption/residency

I am a U.S Citizen by birth, I have officially adopted a little boy from Santo Domingo 12/2005. After the adoption came through I was divorced. I have since remarried, but married someone from the same country with no legal status in the U.S.

I have filed all the necessary paperwork in the U.S for my husbands legal status. Our interview with INS was back in July 2006 - hence have not heard anything from UCIS - my husbands status depends on my son coming to the US - WHY I dont know, I mean I can understand INS and the regulations about now having a "new father" in the picture, but come on. We are seperated from our son. I have an attorney working on expedited our case and the latest info is that I personally scheduled an interview with INFOPASS about two weeks ago - and according to them everything is fine, that our file is pending another interview and that they cannot tell us how long this will take. Come on do I have no rights being a US Citizen???? My son is in danger in the country where he is at, we are all suffering - I am so depressed that this process has taken so long, my son yerns for his family, his current care providers will not be able to care for him much longer, my God what can we do.... be patient? I have been patient through my whole adoption process with hime which did not take the normal time frame, but more like almost 3 years and now I have deal with this. Is there anything we can do at this point? File a lawsuite against INS/USCIS - Please can anyone guide me in path that will bring us together.

Sounds like USCIS is going to be scheduling you & your husband for a Stokes interview. From what I've read, they seem to take place 1yr or so after the initial interview.

From the limited information you've given, its seems that USCIS may suspect your marriage is not genuine and that you are involved in immigration fraud. They will therefore be asking you to come for a second interview, which typically takes the form of a Stokes interview; separate the couple and ask them both the same questions to see if they really know each other/live together. From what I've read, these usually take place 1yr or so after the initial interview.

I suppose USCIS have put a hold on your son's immigrant visa until they clear up whether you are acting in good faith or not.

Whatever their reasoning, it sounds like you need to get yourself prepared for some in-depth questioning.

I am sure that is what immigration believed. But I have faith that the outcome will be great. Our marriage is 100% authentic, but unfortunately INS expects everyone to have "their perfect story" and not life's reality.

But, this is where I question - why this should impact my son after I have legally adopted him if there is not any other way - student visa, etc something to bring him home?

...because USCIS think you are a potential immigration fraudster. Until they clear up that misunderstanding, anything you do will likely get put on hold.
