URGENT HELP: I-140 (Substitute labor) kicked back due to "Mailroom Error"

Hello,

My I-140 was applied using a May 2001 EB3 substitute labor by my current employer, and was received by USCIS on July-13 (USPS tracking#)

Today I got the bad news from my lawyer......

USCIS had returned back my application packet along with a letter saying that the I-140 has been rejected because the original labor petition was not sent along! My lawyer had sent them ETA 750A, ETA 750B, I-140 & other docs.

My attorney is telling me that its a MAILROOM ERROR, and the USCIS mailroom personnel, if not properly trained, failed to recognize a ETA-750A or a ETA-750B & must be expecting a ETA-9089 instead! :(

My attorney had overnighted it today, with a coversheet with the letters "ATTN: SUPERVISOR", and also faxed the USCIS service center.

This issue happened in 2005 also, & I hope I get a receipt notice this time.

The only concern is, substitution labor deadline was July-16, and I hope USCIS does not reject my application. My application has date stamp of July-13, and they had attempted to process the check on July-18.

Attorneys....pls reply back....have u seen this issue before?
