!!!urgent help-going on disability while in I-485

My health is in a bad shape and will be going on disability very soon. If disability insurance dont approve my case, I would be without a job. I am not sure if I would be able to work anytime soon as the treatment process is very long, experimental and outcome unpredictable. Need to stay in USA as this illness is well researched and good treatments available only here.

These are my GC details in TSC- I am in my I485 stage. INS received the I485 application on May7,2001. Receipt date-05-14-2001. Yet to get my finger print notice.

My questions are:
1. Is there a way to expedite my GC processing with INS based on illness reason (my employers said there is no provision for it)
2. What will happen to my 485 processing if I am on disability or without a job for a long time (for eg-3 years)?
3. If I get my FP notice and then I lose my job, what will happen to my GC approval?

Answers:
1. I have not heard that I-485 can be expedited because of sickness.
2. I-485 is for a future job. As long as there is a business/company out there that is willing to promise you a job (similar job referred to by your I-140 application), you should be fine.
3. As answer #2.

Good news is that INS may approve I-485 without asking for RFE or interview.

Thanks for your post. I will sign the petition today.

I called the INS last week to request for fingerprinting. I just have my receipt number with me. My company didn't send me a copy of the I-485 receipt notice. They just gave me the receipt number.

The lady who picked up the call said she did something(didn't mention what she did and teh conversation took just 1 mt) and said that the computer will pick my receipt number from the queue and a finger print notice will be sent.

When i asked her how long it would take, she said it might take 4-6 weeks or more than that. She said she cant assure me of any timeframe.

And then I read in some of the posts here that the INS officer needs to do take down some info like SSN, name etc and fill up the fp notice immediately. She didn't do anything like that.

So, Are they just dodging me? What are the things I should request the INS office so that FP notice is sent soon?

I see that only my case has a 485 receipt date of May 14 2001 and yet to receive a FP notice.

Sorry to hear abt your situation aurovil.

One piece of information that may or may not mean anything:

I called the National Customer Service number and spoke to a lady... told her about how delayed my case is and how much its affecting our lives etc. etc.

She was sympathetic and said that I should send a fax to the TSC director (I can't recall what her title exactly was) Evelyn Upchurch. Will look up the fax number I noted down if you want it(I'm sure its the same fax number everyone on this forum's been using).

She said that I should request an expedite giving valid justification (humanitarian, work related etc) and that they might consider it.

I haven't faxed them yet ('cos I don't think it'll yield anything at this point.. what with almost no movement from TSC nowadays).

But if they are willing to consider these kind of situations, you may have a chance.

Then again do consult your lawyer before doing anything 'cos I don't know how the INS might view your disability situation for approving your 485.

IIO asks for SSN and name, address etc. and other info just to verify that those information in their system is correct OR to verify your identity. They alredy have these info and do not need them to request for FP. You should inform them if address is changed.

Of course they promising to request for FP is no guarantee that you will receive it. They submit your name to another department. Utimately, the "FP department" will send it. Call again if you don't receive it in 4 weeks.

You should request your company to give you the I-485 receipt. As an applicant. you should hold it since you need it for IEAD, travel etc. The notice date is the date INS notifies you or "send you the receipt". It is on the I-485 receipt. It is usually slightly later than RD.

For purpose of the petition, enter RD as your ND.
