Hi All,
I just received a letter from the INS saying that my N-400 application is denied due to abandonment. I have never received the FP notice. It was possibly lost in the mail. My wife and I filed at the same time, she received the FP notice in March but I never receive one. I called TSC in May and was told to call back in November.

The letter says that the decision cannot be appealed. A motion to reopen can be filed only if
1) Request for appearance (for FP) was complied
2) The request was sent to a different address AND I didn't receive.
3) If I advised INS, in writing, of a change in address.

I don't qualify on any of these 3 grounds. What should I do now?

Any reply will be greatly appreciated.

You best option is to file the N-400 again as a new application. Trying to file Motion to Reopen is a long shot and very little chance of success. In the meantime you will loose time also. You can try to contact the Senator and Congressman's office for their intervention. Good luck.
