Guys,

My friend has recd an RFE for a period of his experience where he has no experience letter but has an appointment letter and W-2 to prove that he worked for that co. during that time. Is it enough to satisfy this RFE? He does not have any way to get this letter as the company has closed down and none of his colleagues are contactable. Any advice is welcome. Has anyone been in a similar situation and overcome. Please help!!

Closure of a company where one worked is a common occurance.

If one is not able to contact the management of the company, the second option would have been getting an affidavit from one of the co-workers.

But you are indicating that your friend is unable to do even this.

The last option would be to contact any of the business associates of the old company and ask whether they can give a letter saying that they know, that such and such person has worked for that company. I am doubtful whether this would work but should be tried as a last option.

Thanks for the reply Raju

His attorney is of the opinion that he can show the w2 and appointment letter to show that he had worked there. He is proceeding with this plan.

Jim, Thanks for looking at this

I have since spoken to my friend and here is what has happened. He has the experience letter for the entire period. He had an initial H-1 from Company A and was contracted to work at Company B which later transferred his H1. His experience letter is from Company B for the entire period. BCIS wants to know whether he ever worked for Company A which had his H1 for a period of time. He was going to show his w2 and pay stubs as proof of having worked for Company A. Please let me know your thoughts on this. Thanks for your input.

It might look to INS as if he was working for an unauthorized employer. I guess if it is adequately explained he will be ok. Not the way I would do it if I had a choice though.

Thanks once again, Jim

This is all he has at the moment to show that he ever worked for Company A and that it was authorized. In terms of available paperwork I guess he has no other choice.

It better be clearly explained to INS. Even then I do not like it but "ya gotta do what ya gotta do".

When there is no other choice the decision is simple.

Good News

Jim,

This case has been approved with the information we sent them. The RFE was recd on 3/26 and approved on 3/31!! Thank you for you help in this matter.

Raju thank for your input.

I think he can go with Affidavit of a co-worker who was working with him preferably his manager. My friend did that and he said it worked. He got his I-140.
