URGENT HELP - Can I add my wife to my greencard process -- PriorityDate Retrogression

Here is my case. I got married recently and want to add my wife to my greencard process. She is here with her H4 visa. I got my EAD (I'm not using it yet). My fingerprint is going to be on Oct 11th (I have delayed my previous fingerprints once that was on Sep 16th).

The restrogression priority date is going to get effective from Oct 1st. And my attorney said they cann't file the 485 for my wife within Sep 30, becauce they said the visa numbers are not available ( http://www.travel.state.gov/visa/fr...letin_2616.html ). Is there anyway I can file my wife's 485 within Sep 30th ? My priority date is 09/14/1999 and my category is EB3.

Try to prepare her 485 Tonight. and tommorow sent it overnight urgent, even her medical is not done or manadotary docs are missing. if u get lucky and they accept then atleast her case get started.

What to loose? if application is not accepted they would return ur applicaiton+checks.

Never hesitate to try.

..Yes... the application recieved date should be sept. 30.. I did the same for my wife...I prepared her application in a day...only medical took a week..and her application reached on 26th sept... I am not sure of the medical not sending with the application...since it's inittial evidence..but I think they won't reject the case...they will issue an RFE for initial evidence..

Application as you know is very easy ..does not take more than an hour...make sure you sign it... and put the right fees with it.. 315 for I-485 and 70 for fp... and fedex it by evening today (29th) so that it can reach tommorrow...

You cant file 485.

Your user name sounds to me that you are from INDIA, If so You cant file 485 as EB3 visas are not available even now.
 
YES... gcaaa111 ..is right... I didn't pay attention to ur post..that you are EB3..and if you are from India..then you cannot file for your wife even before sept. 30th... since the visa numbers are not avilable..

sorry for raising your hopes..but prayers will be answered soon...

You did it. People should ask "Are you subject to the visa retrogression?" before gave an idea such as an overnight express mail.
