Urgent Help!!! 140 RFE !!!

Need your Help!!

I filed for my I140 and I485 from a company (COMPANY_A) which I worked before , This company applied my Labor Dec 2001 and finally got approval in July 2003 , Mean while due to down turn of economy I shifted job(Aug 2002) and started working for company(COMPANY_B) with same skills and salary. Due to good faith with my previous employer he did not cancel my applied labor, Once my labor got approved he agreed to file my I140 and 1485 and I intended to join my COMPANY_A once GC comes through. Mean while, I got a RFE on “ability to pay issue” on 06/01/2004 and my attorney answered it on Aug 18th 2004. I have included following documents, Last 3 years W-2's(2001,2002,2003) and all the current pay stubs and previous pay checks of former employer. Previous employer included Audited Tax details and Last 6 months of Revenue details. And COMPANY_A has 150 employees working for them.

My question is :

1. What is the turn around time INS takes to answer a RFE ? It's been nearly 45 days with no change in my status.

2. I received my FP1 notice for both me and my wife for OCT 21 ,And we are planning to change Address from Nov1 . Do you suggest to go for FP earlier ? So that, I have enough time to check the status of Address change with INS?

3.By taking FP earlier, do you see any movement in my 140 RFE ?

PS: I would like to see I140 /FP1 done before I change address.

Any suggestions would be appreciated.

Answers to your questions:

1. It normally takes anywhere between 1-3 months time frame to get a response once RFE is received by INS. So, you should hear something soon.

2. Fingerprinting has nothing to do with your address change. You can do your finger printing even before the scheduled date and it also depends on the city you are going for your fingerprinting.

3. Once your FP is done, and when it reaches Vermont, you would see a change of date in LUD for your 485.
