Urgent: H1B extension

My friend's H1B will be expired eralier next month. He asked his lawyer to apply extension 5 months ago but his lawyer forgot that. So last week when he asked his lawyer the status he knew the problem. His lawyer told him he won't need H1B any more because he filed his I140 and 485 last Sept. and can apply EAD now. His questions are:
1, WHat if his 140 is denied if applying EAD?
2, IF his lawyer files the H1B extension materials right now, is it legal to work after receiving the receipt? or does he have to wait for the extension approval?

Even if he can apply for EAd Now it is unlikely to be approved before next month. Your friend needs an employment authorization to continue to work. Pending I485 gives your friend legal status not work authorization.
1. EAD will also be denied or will become invalid
2. If current H1 has not expired, apply for H1 extension right this week. Your friend can continue to work.
