I had a H1B last year. I used one of 20000 quota for advanced degree. Then I transferred to H4 this year. Now my employer wants to file a new H1B for me. Can I exempt from H1B cap and apply ASAP?
I know that if I was subject to H1B cap within last 6 years, I will not be counted against the new cap in my new app. But I don't know whether my first H1B, which used the 20000 quota for advanced degree is an exemption to H1B or is considered to be counted against H1B cap before.
