My H1B sixth year and H1B VISA on my passport both ends on
March 15, 2007.
Iam planning to go for a vacation to my home country in India
on Feburary 1st week and return by 7th March 2007. I will be
returning just 1 week before my H1B VISA and H1B 6th year expires.
Do you think it will be a problem coming just 1 week before
my visa expiration i.e on 15-Mar-2007? I mean at PORT-OF-ENTRY?
What do you suggest. Whether to carry the 1 year H1B extension
i.e I-797 and then leave or its ok to go without any H1B extension
i.e. I-797. Iam elgibile for 1 year H1B extension after my 6th year, as my
both RIR and PERM LC pending for more than 1 year.
OR
Shall I prepone my travel plans to 1 month before i.e
Travel like Jan 12, 2007 TO Feb 18, 2007. Apply 7th year extension
after coming back from India i.e. apply after Feb 18, 2007. Is that possible?
I heard that I cannot travel once the 7th year H1B
extension is pending with USCIS? Is that true?
Please let me know your valuable advice and accordingly
