Hi,
I got my H1 stamped first time in Feb 2005 and came here in May 2005.
I transferred my H1 to employer B in April 2006
I went to India in August 2006 and returned in Sept 2007
In March 2009 we applied for H1 extension
On 26 April 2009 My H1 got expired and on 06 May 2009 my I 94 got expired
In May '09 we got a RFE and my employer replied to it in June '09
On 28 December 2009 my H1 extension petition online status was changed to denied, we are still waiting for official notification from USCIS with reason and details.
My employer mentioned that they are going to open MTR and apply for a new H1 if required.
My questions:
1. Can I work while my MTR is active?
2. Can I file H1 through a new employer C?
3. Will my new H1 petition fall under quota or irrespective of quota?
4. Am I out of status?
5. My wife's H4 extension also got denied, I have a 3 weeks baby and waiting for her SSN to apply for passport. what should we do right away?
