I recently got my visa changed from J1 to H1 (for wife, J2 to H4). The approval date of I-797 is 22nd Feb 2011; however the valid dates for H1 period written on this notice is 16 Feb 2011 to 19 Dec 2013. Now my previous employer (where I worked on J1 till 14th March, 2011) says that I should not have worked in that company w.e.f. 16 Feb and they will adjust / give salary up to 15th Feb only. How it's possible because the actual H1 approval notice was issued on 22nd Feb and then, it took 7-10 days to reach me by post. Without having received the actual H1 notice in hand, how could I leave the J1- sponsoring company? I still had one year validity left on my J1 and so, I worked until I received the H1 approval notice and then, joined the H1-sponsoring institute. Did I violate anything because I still worked On J1 (my wife on J2) w.e.f 22nd Feb (date of issue of H1/H4) to 14th March (H1/H4 notice received on 11th March) until I received the notices. I think USCIS does understand that it takes time in postage to receive the notice by the beneficiary. Please help!
