I have my H1 extension approved last month. Got the h1 approval along with the I129 petition and all other supporting documents from my company. now my current H1 and the visa stamp expires Mar1 whereas this new extension is valid till Dec2003.
I would be travelling to my home country for my marraige in 3rd week of April.
1] When i travel in april, my visa stamp would have expired on Mar1 itself. But i have my h1 extension with me which is valid till dec2003. Is that o.k? Would i be asked at airport about my expired visa though i have a valid H1?
2] My petition has the consulate box checked. It says within U.S or foreign country India.
Does that mean that i can get my visa stamped only in U.S or foreign country India?
Can i stamp in Mexico or Canada?
IF yes, then do i have to get my petition modified or it is o.k to do without mention of MExico in it?
3] The reason why i am thinking of Mexico is since when i go to India, my visa would have expired. since this is my h1 renewal stamp, i should not have any problems in getting the visa
stamp in India. Is that correct?
But still there is some uncertainty about it. I have a job and i need to come back to U.S.
for which i need to have a visa. I have to get that visa stamped at any cost. I do not foresee
any problems in stamping in India.what do u think? but there is uncertainty.
4] Hence i am thinking of Mexico? Can i do my h1 renewal stamp in Mexico?
Now the ideal thing is to do before mar1[when my current visa expires].
Can i get my h1 renewal done before mar1 in mexico?
how do i get it done in such a short time?
i heard that it takes along time for getting appointments. is that true?
IF i get it , then i would have peace of mind when i travel to India.
5] I heard that only master\'s graduate people can do stamping in mexico or canada?
is that true?
Can a person with bachelor\'s degree do it at these locations?
6] What are the documents needed to carry to these locations? are they same as what i would at India?
7] suppose there is some problem at these locations and they do not grant a visa and ask u to do in India.
does that go against u? Would u have problems in stamping later on in India?
8] Would there be any reasons for not granting visas at Mexico?
Post sep11, how safe it is to do in mexico or canada?
Should i just do it in India and hope and pray to god that nothing happens?
