urgent:FP notice has priority date the same as received date

Hello friends,

Recently I got an urgent matter so I posted here ask for your opinion since I’ve seen a lot of useful information over there in the past.

I received my I-140 and I-485 concurrent filing receipts two weeks ago. I noticed that the “priority date” on those documents was left blank. Thought it was ok.

Yesterday I received my FP notice and the “priority date” on it shows the same date as the received date of my I-140 and I-485 cases(Nov 2004). – Now I really start to worry about it since I am in EB3 category and the 2005 visa retrogression is on the way.

My LC’s priority date is back to Feb 2002. I believe I don’t use LC substitute since my lawyer notified me that my RIR has been approved(he did not give me the approval document through) before we started work on I-140/I-485.

I talked to my lawyer and he claimed “all the FP notices has the date as received date for all cases”. Seems he is not willing to take any action of this matter.

Could any one help give your valuable information:
1. Do you have similar experience with your FP notice? Or does your FP notice always have the correct priority date?
2. Any way I can verify with USCIS about my case’s priority date without going through lawyer?

Thank you very much for any update.

My 140 & 485 receipts did not have priority date and my FP notification did not have "Priority Date" column at all. I do not know where you guys are seeing the priority date on FP notice. Could you please let me know where I can find it on FP notice?

The worst scenario for me could be- my attorney used some other employee's LC approval for my I-140/485 case. Thus my application will be regarded as LC Substitude case and the PD will moved to the I-140/485 received date. I talked to my attorney and he assured me that's not the case. On my insist a request for correction was sent to USCIS to have this fixed.

That's weird. Some of my friends said their FP Notice has no "Priority Date" column but their's are old format FP notice.

My FP notice seems to be in the new format as my wife, who got her FP long time ago (in Mar 04), had a different format which contained "Priority Date". The Priority date on her FP notice says "Nov 28, 03" that is 10 days after our 140 & 485 Notice Date. Since I did not get FP notice at the same time when my wife got her's I am wondering if it could be the reason why my FP notice did not have the priority date.

Ok Guys.I talked2 my attorney today regarding priority date mentioned in fingerprint notice..My attorney says that..priority date in fingerprint notification is nothing but I140/485 received date.Thats the way they are giving the priority date..It has nothing to do with labor filing priority date.
Pls let me know if anyone has some confusion regarding it...
