Hi,
I know that the guidelines for Green Card prohibits the use of experience gained while working on a job for the employer. However, is this scenario allowed:
1. I worked for a company A for 4 years.
(Company A files for GC but it is pending at DOL for a long time).
2. I leave the company and join another company B.
(Company A *keeps* the labor certification application).
3. Due to unfortunate reasons I have to leave B only a month after I joined it.
4. I rejoin company A (after 1 month of leaving it).
Can I then use the 4 years experience I gained while working for company A when company A files for my Green Card again (afresh) -- that is it cancels the first one and files a new one under PERM?
This is kind of urgent. Any information would be highly appreciated.
