enough exp.?
Hi dcmetro22042,
I am kind of facing a similar problem.
Here is my situation, and answers for atty's that I consulted. However, I my labor is not cleared yet. So I do not know for sure.
My min req reads master's + 3 years exp.
At the time of filing LC, I showed all my exp letters to my lawyer and he did not raise any red flags at all.
the problem is that before I joined the petitioning company., my exp is as follows.
1. Nov 10,1999 - July 25, 2002 : 2 y ; 8 months : 15 days. That was a layoff situation with termination date of July 25, 2002. However, I was paid for the next 60 days., and have a letter that says I served the notice period for 60 days. If i include those 60 days it is 2 yr, 10 mon, 15 days. { not sure if the 60 notice days counts}
2. Oct 2002 - Nov 2002 : 2 full months : Not in good terms: so cannot get ex p letter, atleast as of now.
If I can include this, it is 2 yr; 12 mon, 15 days. - above the limit
3.May 98 - July 98 : 3 mos full time ( 40 hours) co-op60 notic
May 99 - July 99 : 3 mos full time ( 40 hours) co-op
Aug 98 - Nov 98 : 10 hours
Jan 99 - May 99 : 10 hours
During 3: I was a student, but worked full time 2 summers ( 6 months).
master's graduation date : Aug 99 bach. grad date : Apr 97
If I can count these 6 months, I am well over the min req; but exp 3 is before my graduation date.
I had put this question to one of Murthy's atty's. She said i infact can include the exp before my master's graduation date, and also that even the part time employment if relevant ( my case it is ), can be converted to equivalent full time employment to show proof.
But she told me that it has to exactly at the minimum be what is asked for in the LC.
I am crossing my fingers also.
In your case, I think if you had a master's : if you can produce an exp letter between bach and master's+ or if you had a job while master's : you can show equivalent full time to get some months of additional experience.
Please consult a competent lawyer, and make sure to ask them if they had solved a similar case before.
As to what you find out, please have me posted as well., when you apply and get your I -140 / 485 approved. cuz., I will soon have to cross the same path.
regards.
