Urgent: CP to Aos after receiving P3

Hi,

I opted for CP during I140 stage. After my I140 approval, NVC sent me a letter asking if I was going to adjust my status(Information sheet regarding Aos aka reconfirmation letter). I stuck to CP and sent them a reply saying so. They created and sent the Packet 3 last week. But situation in my company doesnt seem to be comfortable enough to risk it all on CP(company might close before my expected interview date in January 2003). So I changed my mind to go ahead with AoS and salvage the process using AC-21.

Are there any issues/delays associated with switching to AoS after the packet 3 has been sent by the NVC. Will it delay my I485 receipt. I have NOT sent the Packet 3 to STL.

Your response is highly appreciated..
 
the issue here is that ...

ur file is physically sitting with NVC .... you can file 485 asap but INS cannot do anything on ur case until they get ur file ....

so u should write a letter to NVC telling them of ur decision and requesting them to send ur file back to the INS Service Center where u will file 485 ....
 
im9999 , thank you for your reply. We will be sending a request to nvc regarding the AoS.

When you say INS cannot do anything, does it mean just the actual processing of 485 ? I should still be able to get the receipt notice right?

Thats right.. You will get the receipt notice, EAD, AP and all that but the final approval will not be done unless your file is back.

This means that this case is similar to the one in which AoS is filed after 140 approval when the in the 140 application it has been specified that applicant will file for CP.

The only difference being the NVC sends the letter before Packet 3 , and is replied saying that we applicant will adjust status.
In this case the letter has been answered as saying we will go ahead with CP , Packet 3 is generated, Now we file for AoS , Inform the NVC and wait.

Theoretically the delay should be similar in both the cases.

Correct me if I am wrong.
