Urgent - CP to 485

Hi,
I applied GC via Consular Processing, all paper works had completed. I even got my packet 4 from the consulate and the interview date is next month Jan 15.
However, last week my company annouce to close of the office I'm currently working at and will layoff everyone and my employment will terminate at the end of this year. I tried to persuade my company to let me stay for 1 more month so that I can go for my immigrate interview and get my green card. Of couse, my company refuse to help me out at all, basically they play the I-am-big-corporate-and-I-don't-care card.
I came out with 2 options I think can do.

1) File I-485 right away and hope my next employer can pick up the 485 and continue with it. However, I'm not sure whether is feasible or not.


2) Change to student F1 status, since I'm already a part-time student right now. But I heard somebody mention that INS will not approve my F1 application because one of the requirement for F1 is to show no intention to immigrant which I'm not qualify because I am/was applying for green card.


I am really stress out right now and I'll really appreciate if you can give me some advices/suggestions.

sorry to here that however here is my suggestion...

you must be getting 2-4 weeks of severence package. ask your company to keep you on pay roll ( they can do that legally even after terminating your contract) for that many weeks and ask them to send your last pay check after that many weeks. I know this can be done. negotiate hard with them you have nothing to lose but everything to win at this point.

tell them you are not asking any favour . it is just an adjustment to help you out.

of course i don't know how that works out with CP.
 
one more suggestion. if you have not been served the notice. take sick leave and go to India and attend the interview. I know (but consult with an attorney though) and seen this practice(not sure it is a rule or not) that you can't terminate an enmployee on vacation/leave.

just my 2 cent . take other opinion before u do this kind of things
 
Take the employment letter with current date and take it with you.. It will be just 2-3 weeks old by the time you have your interview and it should not be a problem as you have to get the letter before you go to India and that should be ok... Mostly there should not be any problem. All the best and wish you good luck.
