Hi Ciba and other please clarify .. I am in bad need of your opinion at this stage. Hope you will understand my situation ....
Here is my status:
a] labour cleared.
b] I-140 cleared.
c] Service center CSC
d] Category EB2 [INDIA]
e] Priority date 26th April-2000 [PD Currently at 1st April-2000].
f] H1B used 4.5 years [i.e. only left with 1.5 years]
My Company status:
a] Financially not doing well filed for bankrupcy Chapter-11.
b] Laying off the employees.
c] Assume I will be in payroll for next few months [3 to 4 months]
---- Please Clarify following questions ----
Q1] What is the best option like filing AOS[I-485] or CP ?.
Q2] What will be the impact [like getting RFE .. etc.,] of Bankruptcy
if one applys for either AOS or CP?.
Q3] Will CP going to be a risky process [Possible rejection due to
Bankruptcy]?.
Q4] Since CSC I-485 moving relatively faster, What are the options left for
me?
Q5] In worst condition if I go on "Leave of Obsence" what will be the
implications? For this situation Is CP better option or AOS better?
Q6] Can I reuse Either Labour or I-140 if I move few blocks away in the same street ? Among Labour and I-140 which is position dependent and which is location dependent?
Q7] Can I go for different attoney other than company attorney [since time is so crusial, can\'t afford to loose any time now]? If so what kind of
information I may need from the previous attorney?
Q8] What are the implications, if there is no RFE and company closed in the mean time?
