Urgent: Ciba/ Anyone Please help. AP/EAD issue

Hi,

I received my AP 2 days ago. I was planning to leave for India nxt week. The problem is that my H1 is an extension & is not stamped on my passport...Now if I want to use my AP to get back in will I have any problems at the airport because I dont have a valid work visa.

My EAD hasnt come yet...But by the time I get back from India it will be 90 days from my receipt date . so I can go to the local INS office & get my interim EAD as soon as I get back.

My worry is ...will they let me back in without any problems or do I need to wait for my EAD/ interim EAD before I leave. I asked my lawyer but he is not sure...So any help on this wld be appreciated.

Here is my understanding

EAD is useless for reentry

AP is enough to enter the US based on a 485 pending case. No need for H1 at all.

Please consult your lawyer for legal advice.

you can come back on AP and your status is valid. but your h1 will become invalid unless your passport has stamp on it.
My suggestion is, wait for ead and roll your work authorization to ead, and travel. then you don\'t need h1 stamping.
but ask murthy(free of cost) or someone to take a good help.
