Hi, I came to USA on a B1/B2 visa in April 2005 to take the CPA exam. When I came here I clarified to the Mumbai consulate and immigration on the airport that I will take CPA exam and come back to India.
However, in August 2005 I found a job and my employer applied for change of status from B1 to H1. The change of status is now approved by USCIS and I got my H1. My B1/B2 I-94 is valid till 18th Oct 2005. Now if I leave USA before 18th Oct then its not a problem. If I stay beyond that I will be considered on H1 and then whenever I leave USA I have to get a H1 stamp from Mumbai.
My question is - Is it difficult to get stamping done keepin in mind the fact that a visitor visa was converted to work visa. Will Mumbai consulate give me a hard time or reject me a stamping when I go to India in future?
Is is true that if I go back after a year or more I will get the stamping and if I go immediately in 3-4 months from now the stamping might be rejected?
