My 5th year anniversary is on 4/30/2011 and that makes my 90th day before 5th year anniversary as 1/30/2011.

I will be traveling to India on 1/28/2011 and won't be back till 3/31/2011 (tentative).

Considering the above-

1. Can I sign my N-400 form with the date 1/28/2011 and send it by first class mail so that it reaches Phoenix on 2/1/2011? In other words, does the date on which the form is signed has to be within the 90 day time window or the date on which it is received in Phnx is counted?

2. Do I need to be in US, as in physically present in US at the time of filling the form? Can I file the form while in India lets say on 2/15/2011 and mail it to Phnx by Indian postal service's regular mail? If so, then in part 7 where I list my trips outside of US should I list tentative return date of 3/31/2011 for my latest trip?

Let me rephrase the entire situation above so that it helps in getting some good feedback.

I need to get US Citizenship as soon as possible. My 5th year anniversary is 4/30/2011. However I am leaving US few days before the earliest filing date of 1/30/2011 and won't be back in US till 3/31/2011. I will be away for work related situation and I cannot avoid the travel. What should I do in the above situation? When can I mail the form? What date should I put next to my signature on the form? For the latest trip starting 1/28, should I put departure date as 1/28 and leave arrival date blank or tentative date of 3/31/2011? Should I mail the form while in India lets say around mid Feb?

Anyone in similar situation? Looking forward to some good feedback and ideas.

Thanks

You don't have to be physically in the US when you send the N-400 or when it arrives at USCIS. You can send it from overseas (don't use the mail, use a private international courier like Fedex or DHL). But you need to be in the US for fingerprinting, interview, and oath. With your travel plans, it looks like you'll miss the fingerprinting.

You can leave out the end date of the latest trip on the N-400, and then update it at the interview.

They're supposed to look at the day it's received, but sometimes they reject people for having the postmark date or signing date outside the 90-day window.

Is this trip a one-off situation, or do you expect more trips in the near future?

You said it's work related ... is it for a US company, or international organization (like IMF or NATO)? If yes, and you expect more trips before the oath, consider applying for an N-470, otherwise you'll risk being denied for breaking continuous residence.

Just send your N-400 from India somewhere in mid Feb, that way you will not miss your FP appointment in US which will be scheduled somewhere in March.

This is for my own company (founder) based in US and very likely I wouldn't need another long trip for rest of the year. I guess I will use DHL or FedEx to mail the form from India sometime end of Feb so that by the time I am back I get the FP appointment. Thanks for the response. I really appreciate it.

Thanks
Jackolantern and namecheckvictim. I really appreciate your responses. Will submit accordingly.

Note that they won't grant N-470 for the sole owner of a company who is sending him/herself overseas (but non-owning employees sent by the sole owner may be eligible). But if this is your only long trip before the oath, you won't need it anyway.
