URGENT: As an H1B Can I take W2 and 1099 from my employer

$49,000 is my salary on 7th year H1B extension on July 2006. previously I was working at $43,000. At the end of the year my employer gave me w2 of $43,000. when I remind that my salary is $49,000 since last 6 months, now they are giving me 1099 of $3,000 as nonemployee compensation.

Question: Being on H1B is it legal to accept this kind of 1099 from my employer?

Please help me, your promt reply will be a tremendous help.

1099 Question,

Gurus please share you knowledge. I have h1b visa and working for a company as full time employee. Now I am planning to work as consultant on 1099(corp-to-corp). Is it going to affect my H1B Status. Or please tell me the any other way by which I can work for any other company and can keep my H1B with my current employer.
