This is a bit urgent, because of my wife's travel plans. Thank you very much in advance for your replies and sorry about the last minute questions.
a. She has a valid H1, did not got visa stamped with H1.
b. Her passport has valid H4 (expiry mid-2008), based on my own H1.
c. She wants to do change of status from H1B back to H4.
d. She has to travel out of country tomorrow and be back in USA a month later.
e. She plans to resign from her H1B sponsor company, while out of country, and file a change of status from outside the country...and so that, her reentry will be based on H4.
f. We heard that, it is fine to file from outside the country, but a few last minute inquiries said otherwise and hence wanted to confirm. I have also asked my lawyer...but, no responses yet.
If not, the alternative is to send resignation letter and also do change of status before leaving USA, which is time critical and hence the urgent flag.
