My EAD from OPT will expire June 15. I got married to a USC 1/25/05. At that time I was told that my company is appling H1B for me under the 20,000 exempt, so I didn't pay attention to working permit problem, and only applied I-130 at the end of Feb, and I am still waiting for it to be approved. Now it seems the 20,000 exempt for H1B maybe will not work out. I am thinking of apply I-485 with I-765 to get a EAD now? But it may take upto 3 months. Another option I was told by lawyer of the company that I can try to apply O1 visa since I have a PhD. O1 application needs a lot of materials (ex. 9 recomandation letters by top people in the area), however after I gather everything, they can get a decision in 4 weeks. Since this is a urgent situation. I am thinking try apply I-485/I-765 first (since I almost got everything ready), and try O1 after I gather all the stuff (it can take at least 3-4 weeks). but I am wondering is O1 a non-immigrantion visa? can I still apply it if I applied I-485? And which is the best way to go in my situation?
I know I should move faster before. I really regret that. for the situation now, I will really appreciate any helpful information!!! Thanks in advance!
