Urgent: AP Question

Hi All,

PCEE, Sillyman,etc please suggest me what I have to do in this situation. I am highly worried about the status of my AP renewal. My AP notice date is 25 March,03.

Today I checked my status and it states that::

On June 23, 2003, we mailed a notice requesting additional evidence or information in this case. The notice explains in detail what additional material is needed. If you have questions about the notice, what is required, or if 14 days have passed and you have not received the notice. Please contact the service center where you submitted your application during business hours

PCee, SIllyman, etc:: is this an RFE for AP??? IS their anybody who has seen this type of status for their cases????

WHat should I have to do? I sent all my documents while doing AP renewal.

We received RFE for my spouse AP requesting for marriage certificate(I am the primary applicant). If you are not primary applicant chance may be for M.C.
Also, be ready with all the documentation they might have misplaced some thing.

I am secondary member and I have already sent marriage certificate while doing AP renewal.

Can I call BCIS 1-800# to know about the extra evidence?????????????

Yes. This is an RFE. They might have misplaced this document. No need to worry about this. Don't be panic. It might be for photo or M.C. High chances are for Marriage certificate. We sent M.C for my spouse and still we got RFE. That is very common with CSC. You will get your approval soon once you respond to RFE.

If suppose INS needs some document like MC, then we just have to mail this document only. Or we have to send something else also.

Also whats the mailing address??
 
you will have mailing address on the RFE paper send the documents listed in that to the address mentioned in that.

don't worry about this, RFE is good news - they pulled your case from the shelf. From what I've seen in this group 90% of dependant AP cases get RFE - even if requested documents were originally included.

For AP, there are 3 common things they are asking for: marriage certificate, I-140 and I-485 your spouse if you are applying as dependant.

The RFE envelope will contain three things: the return envelope with INS (yes, INS) address preprinted, the blue paper which says "this is RFE" and the white paper which specifies what you need to send them.

Make copies of all requested documents as well as of the blue paper, put blue paper and requested docs into the BCIS envelope and mail them ASAP by certified mail or priority mail.

I am the derivative alien and My spouse have filed Employment based I-485.

Today I received a letter from INS regarding "AP RFE".

RFE for Form I131 states that:

Evidence of Eligiblity: Submit a copy of your approval notice (Notice of Action, Form I-797) or receipt notice (Form I-797C) for Form I-140, or Form I-360, or Form I-526. If you have filed the I-485 as a derivative alien, submit your spouses I797C for his/her I-485, And the I-797 for his/her approved or pending I-140, I-360, or I-526.

I dont understand exactly what all documents INS needs. Please suggest me what all documents I have to send to INS.

Send I-140 approval. If you are secondary applicant submit spouse I-485 receipt notice and spouse I-140 approval notice.

Also, in addition to PS advice, follow ruxrux advice and send your marriage cert even if they did not ask for it.
