** URGENT AP question **

My employer has recently filed for 140/485 concurrently. Along with 485 they are also doing AP.

My attorney says

"USCIS has recently posted a statement urging I-485 applicants not to leave the US without advance parole"

I'm travelling to India in Nov 04 and by that time if I dont get my AP will I not be allowed to enter US?.

Please advise ASAP.

Do you have a valid visa stamp of your H/L ?
Then you can enter on that - no harm done to your 485 (have your 485 receipt with you).

But be warned that the AP can be considered invalid if you leave before its approval ( am not 100% sure about this - but I've heard opinions on this)
 
I've H1 stamped until apr 2006. I read somewhere in this forum that
if H1 is valid then I'm safe....

I'm thinking to apply 485 next week and before doing that was curious
about AP situation. If I can enter on my valid H1 then I guess i can
apply for 485 and get the receipt in 15 days after its application
and safely enter back.

Please clarify.

Yeah - you can enter on H1 with 485 receipt - no issues.
