urgent - AP/H1 issue. please help

Friends,
Because of family emergency, I will have to go back home in next few days. My 485 is pending and my advance parole is expired on Jan 03. Is there any problem on going and coming back on H1. Please suggest.

I heard that local INS provides advance parole in the same day. My local INS is Newark, NJ. Do you have any information about it?

If you haven't used your EAD for work, you need not use AP at all and you can come back on H1. I went to India in Aug, even though I had AP, I never showed it to INS at POE. But make sure your current status is H1 i.e. you did not use EAD.

I am still maintaining H1. I never used EAD. However I used AP once while coming back from Canada.
Does the use of AP mean out of H1 status? Actually I never went back since I came here on F1.

This makes it complicated. I don't know about this one. I would suggest check with your lawyer. Do not take any chances as your being in status is very critical for 485 approval.
