Hello,

My 140/485 have a notice date of Feb 23rd 2005. My 140 has been approved in April 2005. The company that sponsored (for which I also work currently) has been acquired by another company. 180 days is not yet past since I have petitioned for 485.

So what could be the implications of this merger on my GC processing?


If I get laid off before 180 days is past, what will happen? What is the best course of action to take?



If I get laid off after 180 days is past, can I safely changes jobs provided the job is similar?


If I choose to change the company for a similar job after 180 days, it is OK?

Any advice would be greatly appreciated.
 
Your I-140 got approved very quickly, uh? Which service center? If you are not laid off, you will be ok. The new company can provide an amendment. According to 5-12 new AC 21 Memo, whether the I-485 applicant can change a job depends on the I-485 pending time and what a new job is. If you go for the new job before 180 days but the CIS does not process your I-485 until 180 elapsed, you are still eligible for the I-140 portability. So whether the I-485 is pending for 180 days plus the same or similar job are the two keys regardless of a change of job occurs before or after 180 days.
