Hi,
1) I am on 6th year H1B which expired on Aug 30th 2006. My labor i.e. PERM was filed on 17th May 2006, and then my attorney filed for a H1 extension to recapture the time I spent in India in the last 6 years which is for Nov 4th 2006.
2) I got my H-1B extension approved today till 4th Nov 2007 which was filed only for 4th Nov 2006, and also my labor got certified today.
3) Current scenario, I am about to leave US on 29th Oct, 2006.
Can I stay legally in this country without it affecting my Green Card process?
As in a real scenario, labor + 140 both should be approved to have H1 extension.
