Hi! Guys...
I wanted advice on this rather complex issue....grateful for similar case advice(if any).....
When I came to the US , I had 2 fresh H1Bs...from company A and company B(went to India for getting visa of company B stamped)...now at port of entry the immigration officer saw the old visa(of company A) by mistake and stamped the 94 according to that date...realised it now...after 8 months...when current visa is expiring(of company B).....please advise what to do...in the meantime had filed for 485...already 2 months past....waiting for EAD...will there be any issues now....will there be any problem in INS...will they start considering me out of status.....and will going to the INS office in NY make any difference.....also it has been more than 180 days since my 94 has expired(just for the fact).....
can someone please help!!!!!..
Also my lawyer says that he has filed for H1B extension(it expires on 11/01) and he wants to go to an INS office in NY on 7th November to explain this to the INS….and I am not sure what will be achieved by that.
Could someone guide me please so that I can make a decision…I mean if this thing is going to affect my GC in a later stage, then I will go and get it corrected…even though the dates will already have passed…
Please help!!!!

PS: Just heard on AVM at INS that my EAD and AP have been approved...will it make any difference now....means will there be any problem further in GC processing...like when the time comes for approval of 485 will INS consider me out of status or what....

I was in the same situation sometime back

My company applied for an H1B extension even though there was about one year of time left. I got extension approved and also i-94 with that.

Also another friend of mine got into same trouble. He went to the nearest INS office and explained the situation. They gave a new i-94 to him.

In the worst case if you are near the border go to Canada/Mexico and get a new i-94.
 
i think you need not panic for this situation !!!

do not worry. As long as you are in an H1B visa you would be covered since you have a job and an H1B papers on hand do not worry.

My friend had a similar situation and he went to the airport and the immigration section and expained the situation and they helped him in upating the records for him. But this happend before sep 11 2001.
There should be a way out for you without going out of the country ask a good lawyer he/she may be able to help you.
hopefully you would not have any RFE and you might be approved hoep for this to happen.

But my problem has become more critical .....

now my h1 is expiring on 11/01...and my 94 expired in feb,2001....i filed my 485 on 07/30(RD), ND(09/21)....and just heard on AVM that my EAD and AP ...both approved..will get EAD ...i guess only in mid-november....and lawyer has just filed H1b extension....now he says we should go to INS office in NY on 11/07...and explain to them....my point is will it help in any case....and if I don\'t go...will there be any problem in future.....can INS raise an issue of out of status or anything like that.....u know....i can go to ins office ...but i shouldn\'t get into trouble....lawyer says no problem....but these guys are just to make money...sorry for being so cyncial.....anyways...I know the case is a bit complicated and there is very little time left now....but if any one can please help or guide i would be really grateful...
