Urgent Advice Needed - Expired green card

Hi there,

Here are the facts to the case for Sarah:

- Sarah is 26 year old and is currently residing out of the States but she holds an expired green card.
- Green card was obtained when Sarah was 12 years old. At the time, she was not aware she had a green card and only recently discovered this.
- Green card is expired (a few years ago).
- Sarah has always lived out of the States but wishes to move there permanently.
- She has never filed a US tax return.

(1) What is the probability that Sarah will be able to RENEW her expired greencard?
(2) Is it safer for Sarah to look into renewing her greencard outside of the States or for her to enter the States first and then try to renew her green card?

She won't be able to renew her GC since she is living out of the US during this whole period of time. Her GC is gone.

(2) Is it safer for Sarah to look into renewing her greencard outside of the States or for her to enter the States first and then try to renew her green card?

She won't be allowed to enter in to the US with expired GC. She is now like anyone living out of the US without GC.

Thanks for your response. I agree with your response however, if she entered the states not on her GC but as a visitor and then remains in the states, is there a way for her to renew her GC once she has already reentered the states?

No. Since she has lived out of the US, her GC is gone. She is no loger a GC holder. She has to forget about her that GC.

I agree with Amishah, she's no longer GC holder so if she wants to get a GC, she has to do it all over again from the scratch meaning either from marriage, DV, or employment or whatever channels she used before.
