URGENT-Adjust Of Status - RFE

Hi All:

I recently got an RFE from BCIS for my pending case as talked earlier. I have submitted the documents mentioned below which they requested.

* My past three year W2 tax,
From my current employer (where I joined recently a month plus)
* Paystub,
* Employment verification letter


I would like to know why BCIS has asked RFE?
What will be impact on those document to my pending case?
If its for decision making when how soon I am suppose to expect?
(BCIS received in last week of july 2003 my RFE)
What is the % in the decision going in favour of approving for the my green card.
Incase if its not going to be in favour what is the possible reason they might deny it.

No need of concern

Now a days lot of people are receiving RFEs. Do you know if your previous employer informed BCIS about u not working with them anymore. That could cause an RFE.

Make sure you filed all previous 3 years of taxes.
Take an employment letter from your employer that you have a very good job right now, and it is permanent in nature. BCIS will be more interested in your current job.
Pay stubs, I am sure you have these already.
BCIS provides about 3 months time, check your RFE notice for the actual date you need to reply.

Prepare this paperwork carefully and give it to your lawyer.

What is that AC21 Letter? Can you please tell me briefly.

I recently submitted the below documents as an RFE request by INS on my pending AOS case.
i.e.

* My past three year W2 tax,[/q1]
* From my current employer (where I joined recently a month ago)
* Paystub i gave 2 paystub i.e. by-weekly for a month since i joined one month back. (i.e. month of june)
* Employment verification letter[/q1]


But i just checked my case status and it said they hv sent an request for additional evidence or information, I am just wondering what will be that on ? Do you have any idea? I am just curious to know. If anybody have come across such situation what is INS is looking for please let me know so that I can make the necessity steps for the same.

AC21 is a law that allows you to switch to another employer with similar job offer while your I485 is pending for more than 180 days. Check this forum for more info.

Most people say that you need to submit a letter to BCIS when you switch jobs during I485 pending stage. So I believe you probably need to do the same thing. But seems like you only responded with the info that BCIS requested in the RFE. Not sure if that's going to work out. Suggest you talk to a lawyer.

As far as the online status is concerned, I think it's referring to the RFE you just got. So no need to worry. Wait for a few days and you should see something like "On (date xxx), we've received your response to our RFE, blah, blah, blah"

I am not sure if my lawyer has submitted the AC21, I shall check with them. Yeah basically responding the the RFE which BCIS is enquirying only.

When i submitted the documents to BCIS, the online status that time once BCIS received showed that it has received the RFE and blah blah as you mentioned. But recently in few days back after they got RFE, I saw another status in online that they are requested an additional evidience to be required for my case. So I was wondering what it would be ? Any tips on this will be greatly appreciatable.

probably they are asking for more detailed information regarding your current job to make sure you have the "same of similiar" job as your previous one to qualify for AC21 case.

Please post the details of your 2nd RFE once you get it.

Just to review what happened..

Recently INS asked 1st RFE they asked for my employment letter/paystub. Which I produced nothing more than that. But since I changed the employer from the one who originally filled they have I believe asked for 2nd RFE in which they asked for
"Ability to pay me the salary from the my current employer +
hence in other words to provide evidece that that my employer is able to pay me the salary. Hence INS has requested the current employer to show the annual reports or federal tax returns or audited financial statement etc like that, untill benefiaciay gets the lawfull permanent residence like that. "

Also form DE-6 quartely wage report.

But by the time I am showing the evidence for 2nd RFE, I change my employer. Hence what I am now doing is sending the INS the response of the 2nd RFE along with my recent paystub, employment verification and offer letter of my new employer. This new employer is showing all the documents which ins is willing to see.

Hope I am able to say my situation clear.

So what is the next thing ins is suppose to do after getting the documents.
 
I think as long as you provide all valid documents that can support your AC21 case, you can change as many employers as you wish.
