I have an urgent question:

My I-140 was approved in July 2001 and I-485 was filed to CSC in Feb 2002, Now I got laid off yesterday and already find another job today. Here is my question:
I worked as consultant in my previous company, but that company did not give me any detail information about my LC,even case number, but I have a copy of ETA750 A, B. In ETA 750A, my job title is "Consultant" in column 9, but I cannot find any job with title as "Consultant" from http://www.bls.gov/search/ooh.asp?ct=OOH, also I downloaded all my previous company's LC cases from
http://www.flcdatacenter.com/casesearchperm.asp and found that my LC was filed as OCC code: 030.062
-010, job title is Software Engineer, my question is: which job title should I use in AC21? Currently the new job I get is " Sr. Software Engineer", will this cause any problem? Job description is similiar, almost same to the old one.

Also after I file G28 to change lawyer, what documents will be transfered from old lawyer to the new lawyer? will LC approval be transferred? Is it required that the old lawyer transfer my LC approval to my new lawyer?

Thanks!

Good for you!!

Answers to your question:
1. I know what matters is what is on your LC, so it should be Software Engineer. As long as the job description is similar, it should be fine. When you send an EVL from your new employer ( either before or after you get an RFE), you could get your new employer to mention the same thing that you have on your LC as your job duties/responsibilties in the new job

2. The LC approval should be transferred as well. You should check with your new attroney what are the documents he would need and get those from your old attorney and pass it on

If you haven't received your RFE yet, then this is the right time to start your research.

1. File under FOIA at INS for all documents concerning your case. They have to give you EVERY single document that concerns you. It is a simple process, though you might have to pay a few cents for photo copies.

2. Ensure that your LC job description is same/similar to current job description. Growth from software engineer to Sr. Software engineer, is permisible since it is a logical progression. It is comensurate with your experience and educational qualification.

3. File G8 ASAP, while your old lawyer has to transfer all files to your new one, they could play games, threaten them with FOIA if they are being too coy.

Good luck and keep us posted.

And while I have your attention, allow me point out a couple of things you can do to speed up your 485 process.

Thanks everyone for response!

I got my LC approval from previous company today. in ETA 750 A, column 9, Name of Job Title is "Consultant", but in the right bottom of the form, Occ code is 030.062-010 and Occ Title is "Software Engineer", so which one should I use as LC job title if I need respond INS's RFE? My new job's title is "Sr Software Engineer", it should be OK as long as job duty is same/similiar, right?

Thanks!
